Legislative regulation

In 2022, Federal Law No. 218 was adopted, according to which real estate registration is carried out with simultaneous registration with the Cadastral Chamber. A citizen must contact a cadastral engineer to enter the house into a unified register.

After the adoption of the law on the registration of country houses and buildings, registration of ownership of real estate without land surveying is impossible. If the owner does not establish the boundaries of the land, he does not have the right to dispose of the property.

Dacha plots automatically became garden or vegetable plots

Each plot has a type of permitted use (VRI) - Art. 37 Civil Code of the Russian Federation. According to the Federal Law of July 29, 2017 N 217-FZ, from January 1, 2022, summer cottages automatically become only two types - garden or vegetable plots. There is no need to re-register anything.

A plot of land automatically becomes a “garden plot” if it has VRI that are associated with a garden or dacha: “garden plot of land”; "for gardening"; “for gardening; “dacha land plot”; “for running a dacha farm”; “for country house construction”, etc. (Clause 7, Article 54 of Federal Law No. 217-FZ).

Why do you need to register a country house?

Registration of a country house is necessary because:

  • it becomes possible to dispose of property and conduct legal transactions (sale, lease, donation);
  • the demolition of a building due to its recognition as an unauthorized construction is excluded;
  • it becomes possible to obtain a consumer loan by pledging the building as collateral;
  • disputes with neighbors regarding the legality of land boundaries are excluded;
  • when the building is dismantled by the authorities, the owner receives monetary compensation;
  • the owner can register in a building located in the country.

Standard property registration scheme

  1. This is possible if the owner has the necessary documents ready and updating the existing data is not yet required. You must have a passport, confirmation of the right to a land plot (contracts of donation, purchase/sale, lease, documents on the right of inheritance, court decisions, etc.), a cadastral passport of the plot. A receipt confirming that the citizen has paid the state duty is also attached here.
  2. The next step is that the owner must write an application to Rosreestr. It includes a request for registration, information about a plot of land of a cadastral and boundary nature, and passport data of an individual.
  3. Rosreestr issues confirmation that the documents have been accepted and reviews them within 7-9 days. If there are no discrepancies in the documents (for example, between rights that arose earlier), a corresponding note is made in the Unified State Register of Real Estate.

Important! You can also register ownership as private in a multifunctional center. The registration operation here is absolutely identical to that which occurs in Rosreestr, and the data received by these organizations replenishes the unified information bank. In addition to personal contact, citizens can use the services of regular or e-mail.

Upon completion of all aspects related to the registration of property rights, the citizen receives a corresponding certificate of ownership.

Registration procedure

The procedure for registering a garden house consists of the following steps:

  1. Filling out an application to the BTI to call a specialist who will conduct a technical inspection of the facility.
  2. Preparation of technical documentation for construction. It is carried out in electronic format and certified by the electronic signature of a specialist from the Cadastral Bureau.
  3. Payment of state duty in the amount of 350 rubles for each object requiring registration.
  4. Submission of documentation to the registration authority.
  5. Obtaining an extract from the Unified State Register of Real Estate confirming the right to use real estate.

ATTENTION! For mass construction, you can contact a gardening association. The chairman of the SNT has the right to submit a general application from the cooperative participants.

List of documents

The exact list of documents must be clarified at the local branch of the state registration service. Providing an incomplete package or documents with errors will delay the home registration process.

The main list of documents for registering ownership of a country house:

  • passport;
  • documentation confirming ownership of the object;
  • cadastral plan of the site;
  • technical plan of the facility;
  • duty payment receipt.

ATTENTION! To register buildings erected before March 2015, only a technical plan is required. If the dacha was built later, in addition to an extract from the real estate cadastre, an act of putting the building into operation is required.

You can submit documentation at the local branch of the registration authority or through the MFC. It is possible to submit an application in electronic form through the State Services website.

Registration of ownership of a garden building through the MFC takes more time than in Rosreestr.

Registration deadlines

Registration of a residential building on privatized land will take:

  • Ten days with simultaneous registration and registration of the right of use. Such a scheme is allowed during a dacha amnesty if the initial registration of real estate or its liquidation is carried out.
  • It takes seven days to register ownership of the property.
  • Five days are required to correct the data in the cadastral passport.

If the deadlines for the registration procedure for a residential building are violated, Rosreestr employees face penalties.

Buildings for recreation and site decoration

  • the need for litigation.

To register a country building, it must be recognized as residential. The premises must comply with technical and construction standards. A special commission is appointed to confirm the status of the house. The procedure takes one month.

Register an allotment for only 350 rubles

It is possible to do without extra costs, but this only applies to a rather narrow range of cases. A common option that citizens apply to when registering land ownership, when there is a certificate of the right to lifelong inheritable and permanent ownership of land (PNV). It is not enough to complete a purchase and sale transaction. It is necessary to register ownership according to the new laws.


Registration of land ownership is not always expensive

Why may registration be refused?

In accordance with the law, the state registration service has the right to reject a request for registration of real estate. The owner receives a refusal in the following cases:

  • the boundaries of the land plot extend beyond the lines marked by the cadastral engineer;
  • in the provided documentation there was a discrepancy in information about the characteristics of the land;
  • the area is limited in use.

If a citizen owns a plot that is part of a gardening partnership, it will not be possible to register the house.

If you need to register the land under the house

In this situation, until the house and the plot itself are privatized, the property is considered illegally used, and transactions with it are impossible. When there are cadastral documents for a house, the owners may mistakenly believe that this is enough and do not care about registering the land directly under the house, but it is an integral part of the residential building (apartment). In order to have a cadastral number and a passport for the land, it is necessary to organize geodetic work, which includes topographic survey, measurement with land surveying, as well as clarification of the boundaries with neighbors' plots.

Based on these data, the private individual receives a technical extract, takes the documents to the cadastral organization, and attaches as confirmation a receipt confirming that the state duty has been paid. As a result, a certificate is issued confirming the owner’s right.
